Reminder of February 1, 2010 Effective Date of Amendments to Rule G-8 and Rule G-37 Relating to Bond Ballot Campaign Contributions

The Municipal Securities Rulemaking Board (“MSRB”) reminds brokers, dealers and municipal securities dealers (“dealers”) of the February 1, 2010 effective date of changes to MSRB Rule G-8, on books and records to be made by dealers and Rule G-37, on political contributions and prohibitions on municipal securities business.  The rule change to Rule G-37 requires the mandatory public disclosure of certain contributions to bond ballot campaigns made by dealers on amended Form G-37. The rule change to Rule G-8 requires dealers to create and maintain records of such contributions to bond ballot campaigns. Specific information about the rule changes can be found in MSRB Notice 2010-01.

Reportable contributions made on or after February 1, 2010 through March 31, 2010 must be disclosed on amended Form G-37, which is required to be submitted to the MSRB on or prior to April 30, 2010.[1] Amended Form G-37 is currently available at www.msrb.org/msrb1/rulesandforms/forms/FormG-37.pdf for paper submissions of such required disclosures.[2] The MSRB expects to have the electronic version of amended Form G-37 available on or about March 26, 2010 for users wishing to submit amended Form G-37 electronically through the existing eG-37 System.

[2] Through March 31, 2010, reportable contributions may be disclosed on prior Form G-37 or amended Form G-37.  Beginning April 1, 2010 MSRB will only accept amended Form G-37.
